Tranche 2

From 1 July 2026, businesses in certain industries will have significantly expanded obligations as part of the major "Tranche 2" reforms to the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (the AML-CTF Act). Whether your business is covered depends on whether you provide services classed as "designated services", which are summarised below (exceptions apply, see AML-CTF Act for further details).

Lawyers who provide services in property, commercial or trust law, and Conveyancers, are likely to be captured by the new AML-CTF laws in 2026. Does your Law Firm or Conveyancing Firm provide one or more of the following services (summarised)?

• facilitating real estate or business sale transactions;

• managing client money, assets, or accounts on trust, pursuant to a transaction;

• creating body corporates (companies) or legal arrangements (trusts); and/or

• acting as, or arranging for someone to act as, a trustee of a trust, or a power of attorney to a body corporate (company) or trust.

Most Real Estate Agents and many Property Developers who sell directly to market will be regulated under AML-CTF laws in 2026. Does your real estate business provide one or more of the following services (summarised)?

• brokering the sale, purchase or transfer of real estate, either on behalf of the buyer or the seller;

• selling or transferring real estate as a business activity without the use of an independent real estate agent (such as a property developer selling off-the-plan).

Accountants often provide services that will be regulated under the AML/CTF laws in 2026. Does your Accountancy provide one or more of the following services (summarised)?

• receiving, holding, controlling and/or disbursing client money, accounts or assets in support of a transaction;

• assisting a person to plan or execute the creation or restructuring of a body corporate (company) or legal arrangement (trust);

• selling or transferring shelf companies;

facilitating or acting in a transaction for equity or debt financing relating to a business.

Company Services Providers often provide services that will be regulated under AML/CTF laws in 2026. Does your Company Services Provider provide one or more of the following services (summarised)?

• assisting a person to plan or execute the creation or restructuring of a body corporate (company) or legal arrangement (trust);

• selling or transferring shelf companies;

• acting as, or arranging for another person to act as, any of the following, on behalf of a person (the nominator)

− a director or secretary of a company;

− a power of attorney of a body corporate (company) or legal arrangement (trust);

− a partner in a partnership;

− a trustee of an express trust;

− a position in a legal arrangement which is functionally equivalent to the above paragraphs.

• acting as, or arranging for another person to act as, a nominee shareholder of a body corporate (company) or legal arrangement (trust), on behalf of a person (the nominator);

• providing a registered office address or principal place of business address of a body corporate (company) or legal arrangement (trust).

Most Business Brokers will be regulated under AML-CTF laws in 2026. Does your Business Broker business provide one or more of the following services (summarised)?

• brokering the sale, purchase or transfer of a body corporate (company), either on behalf of the buyer or the seller;

• facilitating or acting in a transaction for equity or debt financing relating to a business.
